SUBJECT: Award of Contract for Moore Bowl Renovation





BACKGROUND:



The structures that comprise Moore Bowl need to be upgraded for both functional and aesthetic reasons. This project has been reviewed and approved by the Board at the preliminary design phase, the schematic design phase, and the construction document/bid phase. The preliminary cost estimate for the improvements approved by the Board of Regents is $4.35 million.

Construction documents were completed and invitations to bid were released on August 12, 2002. A pre-bid conference was conducted on August 20, 2002. Sealed bids were submitted by six (6) general contractors and were publicly opened on September 5, 2002.



University staff and the project architects analyzed the bids. Alternates were considered and several were selected based upon cost and value added to the project. The recommended alternates did not change the low bid, and all bids submitted were in excess of the Board approved project budget of $4.35 million. Based on the bids received, the low bid was $315,232 over the project budget.



As a result of the low bid being over budget by a significant amount, the Board of Regents at its September 13, 2002 meeting rejected all bids received and authorized the administration to conduct negotiations with the three lowest bidders. In addition, the Board of Regents authorized the Board Chair and Vice Chair to approve a contract for the base bid and selected alternates

after final negotiations with the contractors had been completed.





DESCRIPTION:



Following the September 13, 2002 Board of Regents meeting, the three low bidders, Murray & Sons Construction Company, Ferrell Construction, and The Law Company, were contacted to enter into final negotiations for the project including value engineering items identified by the project architects.

Funds will be used from the Washburn University 2001 Series A Bond Issue. The bond funds will then be reimbursed as gifts are received.

RECOMMENDATION:



President Farley recommends the Board of Regents ratify the approval by the Board Chair and Vice Chair for the University administration to enter into a contract for $3,573,685 with Murray & Sons Construction Company for substantial completion not later than August 1, 2003.
